This Privacy Policy (as defined hereinafter) is an electronic record in terms of the Indian Contract Act, 1872, the Information Technology Act, 2000, the rules made thereunder, as may be amended, supplemented or re-enacted from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

PayCraft Solutions Private Limited, a company under the Companies Act, 2013, having its registered office at B-1103/1104 Kailash Business Park, Kailash Complex, Ghatkopar – Powai Link Road, Park Site, Vikhroli (West), Mumbai – 400079, Maharashtra, India. PayCraft owns, manages and operated the website: https://www.paycraftsol.com/ (“PayCraft Platform”) to facilitate and offer a vast repository of dining experiences and deals, gift cards and corporate benefit cards (“Services”) to the user of the PayCraft Platform (collectively referred to as “User” or “Users” or “you” or “your”).

PayCraft respects the privacy of its Users and is committed to protect it in all respects by maintaining the confidentiality of your Information (as defined hereinafter). We value and appreciate your trust in us. This privacy policy (“Privacy Policy”) describes the basis on which your Information will be collected from you on PayCraft Platform or that you provide to us or will be used and processed by us. This Privacy Policy applies to current and former visitors/Users of PayCraft Platform.

THIS PRIVACY POLICY HAS BEEN DRAFTED AND PUBLISHED IN ACCORDANCE WITH THE INFORMATION TECHNOLOGY ACT 2000; THE INFORMATION TECHNOLOGY (AMENDMENT) ACT 2008; AND THE INFORMATION TECHNOLOGY (REASONABLE SECURITY PRACTICES AND PROCEDURES AND SENSITIVE PERSONAL DATA OR INFORMATION) RULES 2011. THIS PRIVACY POLICY CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU, AS A USER OF THE PAYCRAFT PLATFORM AND US, AS THE OWNER OF THE PAYCRAFT PLATFORM. YOU MUST BE A NATURAL PERSON WHO IS AT LEAST 18 YEARS OF AGE.

The purpose of this Privacy Policy is to ensure that there is an intact charter to collect, use and protect any personal and/or sensitive data collected by us. This Privacy Policy defines our procedure for collection, usage, processing, disclosure and protection of any Information obtained by us through the PayCraft Platform.

Any reference made to Privacy Policy in this document shall mean and refer to the latest version of the Privacy Policy.

As a User of PayCraft Platform, you understand and agree that we may collect, use, and disclose your Information in accordance with this Privacy Policy. This Privacy Policy describes what Information we collect about you, how we collect it, how we use it, with whom we may share it, and what choices you have regarding our use of your Information. We also describe the measures we take to protect the security of your Information data and how to contact us.

By visiting and/or using PayCraft Platforms, you are hereby deemed to have read and understood all the terms and conditions concerning the purpose of usage and conditions of disclosure of your Information including personal and sensitive personal data and information (as is understood under applicable Indian laws) and explicitly consent to our use of such information in accordance with the terms prescribed herein. In case you decide to rescind your consent for our use of your Information including sensitive personal data and information, you will need to inform us in writing at info@paycraftsol.com and your usage of the PayCraft Platform may be terminated in such circumstances.

Please note that the only information requested from you is mentioned below in this Privacy Policy and to provide you with better and enhanced services customized to your needs.

I. DISCLAIMER: 

1.1. Please be advised that any Information (as defined herein below) procured by us, shall be:

(a) Processed fairly and lawfully for rendering the Services;
(b) Obtained only for specified and lawful purposes, and not be used in any manner which is against the law or policy in force in India;
(c) Adequate, relevant and not excessive in relation to the purpose for which it is required;
(d) Able to be reviewed by the User, from time to time and updated-if need arises; and
(e) Not kept longer than for the time which it is required or the purpose for which it is required or as required by the applicable law.

WE SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE SUSTAINED BY REASON OF ANY DISCLOSURE (INADVERTENT OR OTHERWISE) OF ANY INFORMATION OR DATA, IF THE SAME IS EITHER (A) REQUIRED FOR SHARING YOUR INFORMATION FOR LEGITIMATE PURPOSES; OR (B) WAS AFFECTED THROUGH NO FAULT, ACT, OR OMISSION OF THE COMPANY.

BY USING THE SERVICES AND/OR PAYCRAFT PLATFORM, YOU EXPLICITLY ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, THE COLLECTION, USE AND TRANSFER OF THE DATA IN THE MANNER DESCRIBED HEREIN.

PLEASE READ THIS PRIVACY POLICY CAREFULLY AS IT AFFECTS YOUR RIGHTS AND LIABILITIES UNDER LAW.

II. GENERAL:

2.1. APPLICABILITY: This Privacy Policy applies to all Services offered by us on PayCraft Platform, except where otherwise provided.

2.2. PURPOSE OF PAYCRAFT PLATFORM: The PayCraft Platform is intended to give a platform to the User to avail our Services as made available at PayCraft Platform. The Services are provided through our PayCraft Platform and an User is open to access/avail any of our Services by following the manner set out at the PayCraft Platform in accordance with our Terms and Conditions as available at.

2.3. INFORMATION OR DATA COLLECTION: Information (as defined hereinafter) is collected directly from you when you voluntarily provide us your consent to use your information and when you access various parts of our Services and/or PayCraft Platform.

2.4. PROCESSING OF INFORMATION: Procession means any operation or set of operations which is performed on Information, whether or not by automated means, such as collection, recording, possessing, structuring, storage, dealing, handling, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

III. INFORMATION WE MAY COLLECT FROM YOU:

3.1. With a view to offer most enriching and holistic experience to its Users, PayCraft offers a vast repository of Services including dining experiences and deals, gift cards and corporate benefit cards. The information about the User as collected by PayCraft are as follows:

(a) Information supplied by Users, and

(b) Information automatically tracked while using PayCraft’s products.

(c) Personal Data means and includes any information that relates to a natural person through which an individual is identified, such as the name, contact details, email address, gender, age, organization name, organization email id or any other relevant material provided by a User, including but not limited to information gathered through availing Services.

(d) “Technical Information” means and includes any information gathered through various technologies that may employ cookies, web beacons, or similar technologies to automatically record certain information from your device through which you use the Platform. This technical information may include your Internet Protocol (IP) address, device or browser type, Internet service provider (ISP), referring or exit pages, clickstream data, operating system, hardware model, operating system version, unique device identifiers, and mobile network. This data includes usage information and user statistics.

(e) “Locational Information” shall mean and include the information obtained through GPS or other means, such as the geographical location of the User.

(f) “Device information” shall mean any information about your device such as time zone, device type, network, operating system, carrier user id, and browser type and other information that alone or in combination may be used to uniquely identify your device or computer for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.

(g) “Non-Personal Information”: (i) “Information through use of our Service” means and includes information which is shared with us to avail our Services.
(ii) “Non-Personal Information” means and includes any information that does not reveal your specific identity, such as, browser information, information collected through Cookies (as defined below), pixel tags and other technologies, demographic information, etc. As is true with most websites, our Company gathers some information automatically when you visit the PayCraft Platform. When you use the PayCraft Platform, we may collect certain information about your computer or mobile to facilitate, evaluate and verify your use of the PayCraft Platform. For example, we may store environmental variables, such as browser type, operating system, speed of the central processing unit (CPU), referring or exit web pages, click patterns and the internet protocol (IP) address of your computer. This information is generally collected in aggregate form, without identifying any user individually.

(h) Registration and User-Provided Information:  (i) When you register to use PayCraft Platforms, we may collect information about you. We may link this Information with other information about you. You may also provide us with information about you in various ways when you use our PayCraft Platforms or send us customer service-related requests. If you contact us, we may keep a record of that correspondence. (ii) Details of your visits to our PayCraft Platform including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access. 

(i) Account Details: These include your username and password and preferred account settings such as the language and time zone etc. 

(j) Billing Details: Shall mean and include billing details such as name, address, email id and other financial information that corresponds to your mode of payment including but not limited to, credit card/ debit card details, net banking information, bank details etc. Please note that confidential information such as the CVV/ PIN Number and the net banking credentials will not be stored by us. 

(The Personal Data, User Information, Technical Information, Locational Information, Non-Personal Information and additional information collected from User respectively are collectively referred to as “Information”) 

3.2. By using PayCraft Platform or its Services, you consent to collection, storage, and use of the personal Information you provide (including any changes thereto as provided by you) for any of the Services that we offer. 

3.3. User Information: To avail certain Services on PayCraft Platform, Users are required to provide certain Information for the registration process that may include but not limited to the following: –

(a) Your name;
(b) Contact number;
(c) E-mail address;
(d) Age; and
(e) PIN code.  

3.4. The Information as supplied by the users enables us to improve our sites and provide you the most user-friendly experience. 

3.5. All required information is service dependent, and the Company may use the above said User Information to, maintain, protect, and improve its Services (including advertising services) and for developing new services. 

3.6. Any Information which is freely available and accessible in the public domain or is furnished under the Right to Information Act, 2005, any rules made thereunder or any other law for the time being in force, shall not be considered as sensitive or Personal Data or information. 

IV. YOUR CONSENT:

4.1. Please note that by providing the Information, you provide your consent and authorize us to collect, use or disclose such Information for the business and other purposes and as stated in this Privacy Policy, and as permitted or required by applicable law. Moreover, you understand and hereby consent that this Information may be transferred to any third-party user for the purpose of providing Services through the PayCraft Platform or to any third-party providers for rendering Services, any jointly developed or marketed services, payment processing, order fulfilment, customer services, data analysis, information technology services and such other services which enable us to provide Services through the PayCraft Platform.

4.2. This Privacy Policy shall be enforceable against you in the same manner as any other written agreement. By visiting or accessing the PayCraft Platform and voluntarily providing us with Information (including Personal Data), you are consenting to our use of the Information, in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, you may refuse or withdraw your consent any time, or alternatively choose to not provide us with any Personal Information. Such an intimation to withdraw your consent can be sent to info@paycraftsol.com

V. COLLECTION OF INFORMATION:

5.1. The Company will collect your Information only when you provide it at the time of signing up or registering at the PayCraft Platform or through e-mails and telephonic surveys. The Company does not control or take any responsibility for the confidentiality of Information including Personal Data shared by you on any third- party website or web page. Please always review and share Information if you consent to their terms and usage of your personal information by them.

5.2. Please note that we do not share any personally identifiable Information with anyone without your explicit consent and always try to maintain the privacy of your Information. However, we may need to disclose your Information when we believe it’s in good faith and necessary to comply with judicial proceeding, court order, legal process or when needed to investigate, act against any illegal, suspected or fraudulent activity.

VI. HOW WE USE THE INFORMATION WE COLLECT:

6.1. We use you Information as collected on the PayCraft Platforms in a variety of ways for providing the Services, including the following:

(a) To provide Services and information that you request;
(b) To operate, maintain, enhance and provide all features of the Services and/or PayCraft Platform, to respond to comments and questions and to provide support to Users;
(c) To understand and analyze the usage trends and preferences of our Users, to improve the Services, and to develop new products, services, features, and functionality;
(d) To personalize our Services and to provide customized advertisements, content, and information; and
(e) To send email communications, including updates, promotions and events, relating to Services offered by us on the PayCraft Platform.

VII. WHEN WE DISCLOSE INFORMATION:

7.1. We may disclose any Information including Personal Data (if required) collected from you to third party to provide Services or where it is necessary for compliance of a legal obligation. Your consent is expressly taken to disclose Information including any Personal Data to third parties in the following circumstances:

(a) We work with third party service providers to provide PayCraft Platform, application development, hosting, maintenance, and other services for us. These third parties may have access to or may process your Information as part of providing those services to us. Generally, we limit the Information provided to these service providers to that which is reasonably necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such Information.  

(b) We may share your Information with our affiliates or subsidiaries subject to the terms of this Privacy Policy.

(c) We may disclose your Information if required to do so by law or in the good-faith that such action is necessary to comply with state or the central laws, in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies or required under applicable law.

(d) We also reserve the right to disclose your Information that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the PayCraft Platform and any facilities or equipment used to make the Services available, or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.

(e) Information about you may be disclosed and otherwise transferred to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which Information is transferred to one or more third parties as one of our business assets and provided that such acquirer, successor or assignee shall also put in place reasonable security standards in accordance with applicable Indian laws.

(f) We may make certain aggregated, automatically collected, or otherwise Non-Personal Information available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our Users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the PayCraft Platform and our Services. 

VIII. YOUR RIGHTS:

You have certain legal rights to obtain Information about whether we hold any Information about you, to access your Information we hold about you, and to obtain its correction, update, amendment or deletion in appropriate circumstances. We intend to collect Information only for the purposes for which it is to be used and strive to take reasonable steps to ensure that the Information we collect is reliable for its intended use, accurate, complete, and current. Some of these rights may be subject to some exceptions or limitations. Your principal rights are as follows:

8.1. RIGHT TO ACCESS, RECTIFY OR DELETE YOUR INFORMATION: You have the right to request us to access, rectify, update, or delete your Information stored with us, on our request or on your own. You can ask us to verify whether we are processing of your Information. You can ask us to rectify our records if you believe they contain incorrect or incomplete Information about you. Lastly, you can ask us to delete your Information if you withdraw your consent or when we no longer need it for the purpose it was originally collected for. In case any Information is shared after your explicit consent, you may also request to rectify or erase that Information. The request to erase, rectify or correct any Information can be sent to us at info@paycraftsol.com.

8.2. RIGHT TO RESTRICT PROCESSING: You have the right to restrict processing of your Information in circumstances where:

(a) You contest the accuracy of you Information;
(b) Prefer to restrict its use rather than having us erase it;
(c) Where you believe we no longer need your Information for the purpose of processing, but you require Information for establishment, exercise or defence of legal claims;
(d) You have objected to processing, pending the verification of that objection.

8.3. RIGHT TO OBJECT TO PROCESSING: You have the right to object to processing of your Information on grounds pertaining to your particular situation, but only to the extent that the processing is necessary for:

(a) The performance of a task carried out in the public interest or in the exercise of any official authority vested in us; or
(b) The purposes of the legitimate interests pursued by us or by a third party. If you make such an objection, we will cease to process you Information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing is for the establishment, exercise or defense of legal claims.

8.4. RIGHT TO DATA PORTABILITY: Where you have provided Information to us, you can ask us to transmit that Information (in a structured, commonly used, and machine-readable format) directly to another company if is technically feasible.

8.5. RIGHT TO ERASURE: You have the right to erase/delete your Information without undue delay in circumstances where: 

(a) Your Information is no longer necessary in relation to the purpose for which is collected or processed;
(b) You withdraw consent on which processing is based;
(c) Information has to be erased for compliance with a legal obligation.

Please note that there are certain exclusions of the right to erasure. Such exclusions include where processing is necessary: 

(a) For exercising the right of freedom of expression and information;
(b) For compliance with a legal obligation; or
(c) For the establishment, exercise or defence of legal claims.

8.6. RIGHT TO WITHDRAW CONSENT: Your participation is always voluntary, and you can withdraw your consent at any time. Withdrawal will not affect the lawfulness of any processing carried out before you withdraw your consent. You can withdraw your consent/terminate by deactivating your account with us subsequent to which your Information will no longer be collected or processed by us. The Company will retain your Information of a terminated member for an indefinite period of time, until specifically asked by you to delete the same. Even after deactivating your account, the Company will continue to protect such Information in accordance with this Privacy Policy.

8.7. RIGHT TO COMPLAINT TO A SUPERVISING AUTHORITY: If you consider that our processing of your Information infringes data protection laws, you have a legal right to lodge a complaint with a responsible authority responsible for data protection. 8.8. RETAINING AND DELETING YOUR INFORMATION: We do not delete your Information on our own discretion. You are responsible for and control the time periods for which you wish to retain this Information. There are controls in your account where you can delete all of the Information in your account. You can delete your Information by sending your request at info@paycraftsol.com . Your Information shall not be retained with us after such a request has been made by you. However, we may retain some of your Information for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

8.9. DATA ENCRYPTION: All the Information transmitted and stored in our server is fully encrypted.

X. COOKIES:

10.1. To improve the responsiveness of the sites for our Users, we may use “cookies”, or similar electronic tools to collect information to assign each visitor a unique, random number as a User identification (User ID) to understand the User’s individual interests using the identified computer. Unless you voluntarily identify yourself (through registration, for example), we will have no way of knowing who you are, even if we assign a cookie to your computer. The only personal information a cookie can contain is information you supply (an example of this is when you ask for deals in a certain location). A cookie cannot read data off your hard drive. Our advertisers may also assign their own cookies to your browser (if you click on their ads), a process that we do not control.

10.2. Our web servers automatically collect limited information about your computer’s connection to the Internet, including your IP address, when you visit our site. (Your IP address is a number that lets computers attached to the Internet know where to send you data — such as the web pages you view.) Your IP address does not identify you personally. We use this information to deliver our web pages to you upon request, to tailor our site to the interests of our Users, to measure traffic within our site and let advertisers know the geographic locations from where our visitors come.

XI. LINK TO THIRD PARTY SITES:

PayCraft Platform includes links to other websites. Such sites are governed by their respective privacy policies, which are beyond our control. Once you leave our servers (you can tell where you are by checking the URL in the location bar on your browser), use of any information you provide is governed by the privacy policy of the operator of the third-party site you are visiting. Third-party’s privacy policy may differ from ours. If you can’t find the privacy policy of any of these sites via a link from the site’s homepage, you should contact the site directly for more information.

XII. INFORMATION SHARING:

12.1. PayCraft shares the sensitive personal information to any third party without obtaining the prior consent of the User in the following limited circumstances:

(a) When it is requested or required by law or by any court or governmental agency or authority to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offences. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing these terms, for complying with the applicable laws and regulations.

(b) PayCraft proposes to share such information within its group companies and officers and employees of such group companies for the purpose of processing personal information on its behalf. We also ensure that these recipients of such information agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. 

XIII. ACCESSING AND UPDATING PERSONAL INFORMATION:

When you use PayCraft Platform, Services or products such as cards, we make good faith efforts to provide you, as and when requested by you, with access to your Personal Data and shall further ensure that any Personal Data or sensitive personal data or information found to be inaccurate or deficient shall be corrected or amended as feasible, subject to any requirement for such personal information or sensitive personal data or information to be retained by law or for legitimate business purposes. We ask individual Users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

XIV. INFORMATION SECURITY:

14.1. We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data.

14.2. All information gathered on PayCraft Platform is securely stored within the PayCraft’s controlled database or databases of the agencies and institutions working for us and mandatorily comply with our Privacy Policy. The database is stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, as effective as our security measures are, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet. And, of course, any Information you include in a posting to the discussion areas is available to anyone with Internet access.

14.3. However, the internet is an ever evolving medium. We may change our Privacy Policy from time to time to incorporate necessary future changes. Of course, our use of any Information we gather will always be consistent with the policy under which the information was collected, regardless of what the new policy may be.

14.4. Any complaints or concerns with regards to content or to report any abuse of laws or breach of these terms may be taken up with the designated grievance officer as mentioned below via post or by sending an email to info-Security@paycraftsol.com.

XV. CHILDREN’S PRIVACY:

If you are under the age of 18 (eighteen) years, you must not use PayCraft Platform or submit your Information unless you have the consent of or are supervised by a parent guardian. In the case we discover that a child under 18 (eighteen) years of age has provided us any of its Information, we will immediately delete such information from our servers. If you are a parent or guardian and you are aware that your child has provided us with its Information, please contact us at info@paycraftsol.com so that we will be able to do the necessary actions.

XVI. CONFIDENTIALITY:

You must maintain confidentiality, and not disclose to any other person, any information and content that you access or learn in connection with your participation or use of PayCraft Platform. You are prohibited from sharing with any third party, photographic or other imagery, information, or any other content from any and all activities within or from PayCraft Platform. You must not use any such information or content for any purpose other than your participation in the Service in accordance with this Privacy Policy. You hereby agree to notify the Company immediately if you learn of or suspect any use or disclosure of, or access to, any such information or content other than as specifically authorized in this this Privacy Policy.

XVII. TERMINATION OF USE:

The Company reserves the right to cancel or invalidate your account(s), registrations, points and rewards, deny redemption of your rewards, or restrict, block, limit, and prevent your access to and use of PayCraft Platforms for violation of any Terms and Condition or any policy of the Company or requirements of applicable law.

XVIII. REDRESSAL MECHANISM:

Any complaints, abuse or concerns with regards to content and or comment or breach of these terms shall be immediately informed to the designated Grievance Officers through email signed with the electronic signature to info-security@paycraftsol.com .

We request you to please provide the following information in your complaint:

  1. An electronic signature of a person authorized to act on behalf of the copyright owner for the purposes of the complaint. 
  2. Identification of the copyrighted work claimed to have been infringed. 
  3. Identification of the material on PayCraft Platform that is claimed to be infringing or to be the subject of infringing activity.

If you choose to visit the PayCraft Platform, your visit and any dispute over privacy is subject to this Privacy Policy and the Terms and Conditions. In addition to the foregoing, any disputes arising out of this Privacy Policy shall be governed by the laws of India and you hereby agree that any such dispute shall be submitted to the exclusive jurisdiction of the competent courts of Mumbai, Maharashtra, India.
